关于二手房买卖的税费

关于二手房买卖的费用(2012-3-1)

1、关于限购

对已拥有1套住房的本市户籍居民家庭(含驻京部队现役军人和现役武警家庭、持有有效《北京市工作居住证》的家庭,下同)、持有本市有效暂住证在本市没拥有住房且连续5年(含)以上在本市缴纳社会保险或个人所得税的非本市户籍居民家庭,限购1套住房(含新建商品住房和二手住房);对已拥有2套及以上住房的本市户籍居民家庭、拥有1套及以上住房的非本市户籍居民家庭、无法提供本市有效暂住证和连续5年(含)以上在本市缴纳社会保险或个人所得税缴纳证明的非本市户籍居民家庭,暂停在本市向其售房。

2、关于契税

凡在2002年7月1日之后缴纳契税的,一律适用3%的税率。

自2011年12月10日起,北京市享受优惠政策普通住房平均交易价格调整为按照全市住房平均交易价格结合区位调整系数确定。其中,全市住房平均交易价格为2010年成交均价每平方米建筑面积18000元;区位调整系数按照环线区域和方位不同分为七档,分别为四环内北部1.8、南部1.6,四至五环北部1.5、南部1.3,五至六环北部1.2、南部1.0,六环外0.8。南、北部地区以莲石西路经广安门内大街至京沈高速公路一线为界划分。

享受优惠政策的普通住房,应同时满足以下三个条件:住宅小区建筑容积率在1.0(含)以上;单套建筑面积在140(含)平方米以下;实际成交价格低于按该通知标准确定的所在区域普通住房平均交易价格1.2倍以下。

通过计算(公式为:每平米价格上限=平均交易价格(18000元/平方米)×调整系数×1.2),北京市享受优惠政策住房的每平米价格上限是:四环内北部地区为38880元、南部地区为34560元,四至五环北部地区为32400元、南部地区为28080元,五至六环北部地区为25920元、南部地区为21600元,六环外地区为17280元。

符合新的普通住房标准所能享受的税收优惠政策包括:个人将购买超过5年(含5年)的普通住房对外销售的,免征营业税。对个人购买普通住房,且该住房属于家庭(成员范围包括购房人、配偶以及未成年子女)唯一住房的,减半征收契税。对个人购买90平方米及以下普通住房,且该住房属于家庭唯一住房的,减按1%税率征收契税。

3、关于营业税

自2011年12月10日起,个人将购买不足5年的普通和非普通住房对外销售的,全额征收营业税5.5%;个人将购买超过5年(含5年)的非普通住房对外销售的,按照其销售收入减去购买房屋的价款后的差额征收营业税;个人将购买超过5年(含5年)的普通住房对外销售的,免征营业税。

4、关于中介费

北京市住宅买卖经纪服务收费标准统一500万以下2%。

房地产经纪机构(以下简称经纪机构)提供的其他服务,由当事人自愿选择,通过合同明确约定。其中代办房地产登记服务收费,最高不超过500元/宗;代办贷款服务收费,最高不超过300元/宗;办理房屋入住有关手续收费,最高不超过200元/宗;按照委托人要求,提供的其他服务实行市场调节价,由委托人与经纪机构协商议定。

5、关于个税

二手房个人所得税的缴纳,有两种方式可以选择,一是按照总房价的1%缴纳;二是按出售价格与原购买价格的差额的20%来缴纳。但是在实际操作中,纳税人一般都是选择按照总房价的1%缴纳。

自2011年8月10日起,西城区(包括原宣武区、原西城区)地税对个人所得税进行调整,商品房无论是否满5年,只要产生个人所得税,一律按差额的20%征税。在北京的二手房交易中,只有满5年、且是卖房家庭唯一住房的房屋,在出售时,不用缴纳个人所得税,不满足上述两个条件的,都需缴纳个人所得税。
